General terms and conditions
1. General

Every person (in the following guest called) can take part in the events of bergkontakte Christian Horn (in the following bergkontakte called), if healthy, full aged, is possible to resists the demands and is equipped accordingly. The demands and material lists are contained in each programme.

2. Booking

With the booking on www.bergkontakte.com, the guest offers bergkontakte an conclusion on service contract obligingly. The contract is confirmed by sending the booking confirmation by bergkontakte and at the latest with the transfer of the expected deposit by the guest. The guest agrees with the storage of his data within the scope of the business progress (see disclaimer of liability / 4th data protection).

3. Payment

With sending of the booking confirmation a deposit at 25% is due within 15 days. The final payment is due to 15 days before the event start. If a booking occurs within 15 days before the event start, the full event price is directly due.

4. Prices and achievements

The extent of achievements is evident from the program descriptions with prices. The events lead exclusively by the mountain guides UIAGM or aspirants on mountain guide's under supervision. The programme shows the planned course without guaranteeing the exact course. Caused by alpine dangers, avalanche danger, bad weather, street relations or the abilities of the participants changes of the course are possible. The prices are on per guest (per person), if not mentioned differently.

5. Insurence

bergkontakte is liabil within the scope of our professional liablilty insurance for damage on persons, stuff and financial looses, due to misstakes of bergkontakte or the person who is responsible leading the event. General the guest participates on the event on his own risk. If there is no insurance cover by a membership in any alpine club like DAV (Germany), OEAV (Austria), SAC (Swizerland) or equivalent bergkontakte recommends to cover an insurance for the requested trip. For the insurance cover the guest is responsible on his own.

6. Min. number of participants

All events can be carried out basically only if the given least number of participants is reached. If not bergkontakte can cancel the contract till 14 days before the event start. The guest gets back the complete deposit. If the guest wishes, nevertheless, the realisation of the event, bergkontakte presents a new offer which results in a new contract of services.

7. Cancellation by guest

The guest can cancel his booking at any time. The following is valid for different cases: a. cancellation till 15 days before the event start: there will be no cancellation charge for the guest. The complete deposit will be transferred back. b. cancellation within 14 days before the event start: cancellation charge is 50% of the event price. c. cancellation during the event: the cancellation charge is 100%.

8. Cancellation by operator

bergkontakte can withdraw from the contract in the following cases: a. the least number of participants is not reached, till 14 days before the event start. All payments in advance will be transferred back. b. During the event if the guest is not in condition to persist the challenges of the trip, technical abilities and illness. There will be no payment transferred back. The decision is taken by the mountain guide leading the event.

9. Higher risks due to alpine dangers

At all mountain sport activities a raised accident and injury risk exists basically by fall, height mountain sickness, cold damages, avalanche danger, crevasse fall, rockfall). In spite of circumspect tour planning and thoughtful caring by the mountain guide, a rest risk always remains. The guest must bear himself this alpine rest risk. An adequate tour preparation by endurance sports, suitable technical practise, personal circumspection and an early arrival for altitude acclimatization diminishes this risk. Additional it is recommended to prepare your tour and aims by reading guidebooks and technical literature. The leading mountain guide on site has the right to adapt the tour to the existing alpine dangers and the abilities of the participants.

10. Rental equipment

If the guest is not completely equipped for the planned tour or private activity it is possible to rent equipment or material from bergkontakte. Which equipment and how long the guest needs, they can ask for about our rental form (programm chapter special / material inquiry). Renting fees are performed in the form. A normal usage is satisfied with the fee. Should the equipment have been more intensive abrasion, or entered in loss, the guest is obliged to the equivalent substitute. Improved shopping terms of bergkontakte can be used. If an efficient transfer is not possible, it is possible to send by post or parcel service. The charge for this is to pay by the guest.

11. Operator

Operator is bergkontakte Christian Horn mountain guide UIAGM, VDBS licence no.595, master of civil engineering (fh). All events are thoughtful prepared and carried out. But there is no guarantee for summit ascents or other aims of the event.

12. Legal domicile

A guest is only allowed to indict bergkontakte at the location Konstanz.

13. Invalidity

If one or more chapters in this GTC are invalid, the others are still valid. By mutual acordance we try to find a solution on any problem, otherwise legal regulation are drawn on.
